Terms of Service
The agreement for using ARKHOS, written in plain English.
Last updated: October 14, 2026
These Terms of Service (“Terms”) are an agreement between you and [COMPANY LEGAL NAME], [MAILING ADDRESS] (“ARKHOS”, “we”, “us”). They apply when you create an account or use ARKHOS. If you use ARKHOS for a business, you accept these Terms for that business, and “you” means the business. You must be at least 18 years old.
These Terms include our Privacy Policy, Acceptable Use Policy and AI Policy.
1. The service
ARKHOS is software that helps service businesses run bookings, scheduling, customer communication, payments, hiring and marketing, with AI assistance. ARKHOS is in early access: features may change, and some may be labeled beta. We may improve, change or remove features. If we remove a major feature you pay for, we will tell you in advance.
2. Your account
- Give accurate information and keep it up to date.
- Keep passwords and sign-in codes secret. Turn on two-factor authentication where available.
- You are responsible for what happens under your account, including what your team members do with the access you give them.
- Tell us right away at [email protected] if you think your account has been compromised.
3. Free trial and subscription
- Trial. New accounts get a 14-day free trial. No card is needed to start it. We will not charge you unless you choose a paid plan.
- Plans and prices are shown on our Pricing page. Subscriptions are billed in advance each billing period and renew automatically until you cancel.
- Cancel anytime from the app or by emailing us. Cancellation takes effect at the end of the current billing period. Except for the guarantee below or where the law requires otherwise, we don’t give refunds for partial periods.
- Price changes apply from your next billing period, and we will tell you at least 30 days before.
- Taxes. Prices do not include taxes unless stated. You are responsible for applicable taxes.
- If a payment fails, we may limit or pause the account after notice until it is paid.
4. The ARKHOS 90-day guarantee
If ARKHOS doesn’t save you time, you don’t pay for it. If you cancel within the first 90 days of your paid subscription because ARKHOS didn’t save you time, we will refund all the subscription fees you paid during those 90 days.
- No forms and no proof. Just email [email protected] within those 90 days.
- The refund covers ARKHOS subscription fees only. It does not include third-party charges, such as Square payment processing, SMS or other providers’ fees.
- Once per business.
5. Payments to your business
Payments from your customers are processed by Square through your own Square account, under your agreement with Square. ARKHOS is not a bank, payment processor or money transmitter, and does not hold your funds. Square’s processing fees are charged by Square; ARKHOS does not add a markup. Refunds, chargebacks and disputes with your customers are between you, your customer and Square. The same applies to other accounts you connect, such as Twilio, Quo, Gmail or QuickBooks: you are responsible for those accounts and their fees.
6. Your data
- You own your data. “Customer Data” means the information you and your team put into ARKHOS, including data about your customers, crew and applicants. You keep all rights to it.
- You give us permission to host, copy, process and display Customer Data only as needed to provide, secure and support the service, and as described in our Privacy Policy.
- We may use de-identified, aggregated information about how the service is used (for example, how often a feature is used) to run and improve ARKHOS. It will not identify you, your customers or your team.
- You are responsible for having the right to use Customer Data in ARKHOS, for giving your customers and crew any notices your law requires, and for getting consent for texts, calls, call recording and marketing.
- Moving your data in. If you ask, we can help import your data from your previous software or spreadsheets. Any timeline we give for an import is a good-faith estimate, not a contractual commitment, because it depends on the data you send us. Please review imported data before you rely on it.
7. Acceptable use
Use ARKHOS lawfully and follow our Acceptable Use Policy. In particular, don’t send messages without the consent the law requires, don’t try to access other businesses’ data, and don’t try to break or overload the service.
8. AI features
- ARKHOS AI can draft messages, answer questions and propose actions. By default, actions that move money, message customers in bulk, change settings or delete data are not carried out until an authorized person approves them.
- If you choose to let the AI act on its own for some kinds of actions, you are responsible for the actions it takes within the permissions you gave it.
- AI output can be wrong. Review it before relying on it, especially prices, schedules, payments and anything sent to customers.
- Details are in our AI Policy.
9. Third-party services
ARKHOS connects to services we don’t control (for example Square, Twilio, Quo, Google and QuickBooks). Their terms govern your use of them. We are not responsible for their availability or for what they do with data you send them through your own accounts.
10. Our software and feedback
ARKHOS, including the software, design and brand, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable right to use it during your subscription under these Terms. Don’t copy, resell, reverse engineer or build a competing product from it, except where the law allows. If you send us feedback, we may use it without any obligation to you.
11. Cancellation, termination and export
- You can stop using ARKHOS and cancel at any time.
- We may suspend or end your access if you seriously or repeatedly break these Terms, don’t pay, or if needed to protect the service, other users or the public. Where reasonable, we will warn you first and give you a chance to fix the problem.
- Export. You can export your main records (customers, bookings and team) from the app at any time. After your account ends, you have [POST-TERMINATION EXPORT WINDOW, e.g. 30 days] to export your data or ask us for a copy. After that we may delete it, as described in our Privacy Policy.
- Sections that by their nature should continue (such as payment owed, data ownership, disclaimers, limits of liability and governing law) survive termination.
12. Disclaimers
We work hard to keep ARKHOS reliable and accurate, but the service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that ARKHOS will be uninterrupted or error-free, or that AI output will be correct. ARKHOS does not give legal, tax, employment or financial advice.
13. Limitation of liability
To the extent the law allows: (a) neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; and (b) each party’s total liability arising out of these Terms is limited to the amount you paid ARKHOS in the 12 months before the event that caused the claim. These limits don’t apply to your payment obligations, to a party’s indemnity obligations, or to liability that cannot be limited by law.
14. Indemnity
You will defend and compensate ARKHOS for third-party claims arising from Customer Data, your messages to your customers or crew, or your breach of these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of the State of [GOVERNING STATE], without regard to conflict-of-law rules. Courts located in [GOVERNING STATE] have exclusive jurisdiction, unless the law where you live gives you the right to bring a claim elsewhere. Before filing a claim, please contact us at [email protected] so we can try to resolve it informally.
16. Changes to these Terms
We may update these Terms. If a change is material, we will notify account owners at least 30 days before it takes effect. If you keep using ARKHOS after that, the new Terms apply. If you don’t agree, you can cancel before they take effect.
17. General
These Terms are the whole agreement between us about ARKHOS. If any part is unenforceable, the rest stays in effect. Not enforcing a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Neither party is responsible for delays caused by events beyond its reasonable control.
